Terms of Use

  • Introduction
    Welcome to QuestPlay, a mobile application for fantasy sports. These Terms of Use ("Terms") govern your access to and use of QuestPlay's services, including our website, mobile applications, and any related content, features, functionality, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
  • Eligibility
    You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms and that entity accepts these Terms.
  • Account Registration
    To access certain features of the Services, you may be required to create an account. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to notify QuestPlay immediately of any unauthorized use of your account or any other breach of security. QuestPlay will not be liable for any loss or damage arising from your failure to comply with this section.
  • User Content
    The Services may allow you to submit, post, and share content, such as text, images, and other materials (collectively, "User Content"). You retain all rights in and to your User Content, subject to the rights granted to QuestPlay in these Terms. By submitting User Content, you grant QuestPlay a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or control all rights in and to your User Content and that your User Content does not infringe upon the rights of others.
  • Prohibited Conduct
    You agree not to:
    • Use the Services for any illegal purpose or in violation of any local, state, national, or international law.
    • Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right.
    • Interfere with security-related features of the Services, including by disabling or circumventing features that prevent or limit use or copying of any content.
    • Interfere with the operation of the Services or any user's enjoyment of the Services, including by uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code.
    • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm QuestPlay or users of the Services or expose them to liability.
    • Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services.
  • Intellectual Property Rights
    The Services and all content and materials available on the Services, including but not limited to text, graphics, images, music, software, audio, video, information, data, and other materials (collectively, "QuestPlay Content"), are the property of QuestPlay or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, distribute, modify, create derivative works from, display, perform, publish, license, sell, or otherwise exploit any QuestPlay Content without our prior written consent.
  • Third-Party Services and Content
    The Services may contain links to third-party websites, services, and content (collectively, "Third-Party Services"). QuestPlay does not control, endorse, or adopt any Third-Party Services and is not responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof. Your use of Third-Party Services is at your own risk.
  • Privacy Policy
    QuestPlay values your privacy. Please review our Privacy Policy for information on how we collect, use, and disclose information about you. By using the Services, you agree to the terms of our Privacy Policy.
  • Termination
    QuestPlay may terminate or suspend your access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
  • Indemnification
    You agree to defend, indemnify, and hold harmless QuestPlay, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.
  • Disclaimer of Warranties
    THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, AND QUESTPLAY (AND OUR SUPPLIERS) EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE (AND OUR SUPPLIERS) MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE. IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SERVICES, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF FIRST USE.
  • Limitation of Liability
    IN NO EVENT WILL QUESTPLAY (AND OUR SUPPLIERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST DATA, COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF QUESTPLAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, THE SERVICES IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM.
  • Governing Law and Jurisdiction
    These Terms and any action related thereto will be governed by the laws of India without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the courts located in India, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
  • General
    These Terms constitute the entire agreement between you and QuestPlay concerning your use of the Services. The failure of QuestPlay to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will be enforced. You may not assign or transfer these Terms without our prior written consent. QuestPlay may assign or transfer these Terms without restriction. Your use of the Services, and any related documentation, is subject to all applicable export control laws and regulations.
